AGB
ALLGEMEINE GESCHÄFTSBEDINGUNGEN (AGB)
1. Geltungsbereich
Diese AGB gelten für alle Verträge zwischen Raphael Plie (Verkäufer) und dem Käufer.
2. Vertragsschluss
Der Vertrag kommt zustande, wenn der Verkäufer die Bestellung des Käufers durch Bestätigung oder Lieferung annimmt.
3. Preise und Zahlung
Alle Preise sind in Euro angegeben und verstehen sich ohne Umsatzsteuer, da der Verkäufer von der Umsatzsteuer befreit ist (Kleinunternehmerregelung). Versandkosten werden zusätzlich berechnet. Zahlung erfolgt per [z.B. Banküberweisung, PayPal]. Der Kaufpreis ist sofort fällig.
4. Lieferung
Die Lieferung erfolgt an die vom Käufer angegebene Adresse. Lieferfristen sind unverbindlich, es sei denn, sie wurden ausdrücklich vereinbart.
5. Eigentumsvorbehalt
Die Ware bleibt bis zur vollständigen Bezahlung Eigentum des Verkäufers.
6. Widerrufsrecht
Käufer können den Vertrag innerhalb von 14 Tagen ohne Angabe von Gründen widerrufen. Rücksendekosten trägt der Käufer, es sei denn, der Verkäufer hat etwas anderes vereinbart.
7. Mängelhaftung
Käufer müssen Mängel innerhalb von 14 Tagen nach Erhalt der Ware melden. Bei Mängeln erfolgt Nachbesserung oder Ersatzlieferung.
8. Haftung
Der Verkäufer haftet nur für vorsätzlich oder grob fahrlässig verursachte Schäden. Für Schäden an Leben, Körper oder Gesundheit haftet der Verkäufer unbeschränkt.
9. Schlussbestimmungen
Es gilt österreichisches Recht. Gerichtsstand ist der Sitz des Verkäufers, wenn der Käufer Kaufmann ist. Sollte eine Bestimmung unwirksam sein, bleibt der Rest der AGB gültig
GENERAL TERMS AND CONDITIONS
1. Scope of application
These General Terms and Conditions apply to all contracts between Raphael Plie (Seller) and the Buyer.
2. Conclusion of contract
The contract is concluded when the Seller accepts the Buyer's order by confirmation or delivery.
3. Prices and payment
All prices are quoted in euros and do not include VAT, as the seller is exempt from VAT (small business regulation). Shipping costs are charged additionally. Payment is made by [e.g. bank transfer, PayPal]. The purchase price is due immediately.
4. Delivery
Delivery is made to the address specified by the buyer. Delivery times are non-binding unless expressly agreed.
5. Retention of title
The goods remain the property of the seller until full payment has been received.
6. Right of withdrawal
Buyers may withdraw from the contract within 14 days without giving reasons. The buyer shall bear the costs of return shipping, unless the seller has agreed otherwise.
7. Liability for defects
Buyers must report defects within 14 days of receipt of the goods. In the event of defects, the goods shall be repaired or replaced.
8. Liability
The seller is only liable for damage caused intentionally or through gross negligence. The seller is liable without limitation for damage to life, limb or health.
9. Final provisions
Austrian law applies. The place of jurisdiction is the seller's registered office if the buyer is a merchant. Should any provision be invalid, this shall not affect the validity of the remaining provisions.
